Abelove charged with felony perjury, official misconduct Rensselaer County DA under investigation for conduct in shooting probe

TROY — Rensselaer County District Attorney Joel E. Abelove was charged with felony perjury and two misdemeanor counts of official misconduct on Friday following a grand jury investigation into his controversial handling of the fatal police shooting of a DWI suspect. The Times Union reported last year that Abelove did not subpoena two civilian witnesses who were at the scene of the shooting and told investigators they did not believe the officer was in imminent danger when he opened fire on the motorist. There is also no indication that the attorney general’s office will seek to undo that grand jury proceeding, in which French was allowed by Abelove to testify without an immunity waiver, which means he could not have faced criminal consequences no matter what the panel decided. “My office will continue to work collaboratively with law enforcement agencies across the state, including district attorneys, to ensure fair, comprehensive, and independent investigations of every case within our jurisdiction, so that families like the Thevenins get the answers they deserve.” After French was cleared, Schneiderman accused Abelove of making an “end run” around Cuomo’s executive order by rushing the case before the grand jury at a time when the attorney general’s office said it would review the shooting.
